ONTRAC Rent a Car OPERATES AS A BROKER FOR THIRD PARTY SERVICES AND ASSUMES NO LIABILITY FOR ACTIONS OF AND/OR NEGLIGENCE OF THE THIRD PARTY SERVICES PROVIDERS RELATING TO PROVISION OF AND/OR FAILURE TO PROVIDE ANY SERVICES.

The rental vehicle will be delivered to you directly by our partnering Car Rental Companies in our capacity as acting agent. ONTRAC Rent a Car does not own or operate any Car Rental Companies. Your contract for car rental will be between you and the Car Rental Company. Each car rental company (the “Car Rental(s)”) has its own regulation governing the services and rates applicable to cars for rent (the “Car(s)”).

By using our website, you are declaring that you accept and understand all aspects of our Terms of Service and the Privacy Policy of our site. We may change the Terms from time to time and you, the Renter, are advised to check the website to consider any changes to the Terms which apply to you. Your signature on any rental contract agreement is definite proof of the acceptance of the services and terms imposed by the Car Rental Company and to the respective laws of the country in which the rental will take place.

Both our Terms of Service and those of the Car Rental Companies we work with contain some exclusions and limitations of liability. If you, the Renter, do not agree with any part of them, you must not proceed with your booking.

Please note that you, the Renter, will not conclude any car rental contract at the offered price until your booking has been confirmed and the necessary payment received. If you have any questions, please feel free to contact us.

Rental Service Limitation of Liability

THE RENTAL CAR COMPANIES ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF THE COVERED PARTIES. TO THE EXTENT PERMITTED BY LAW, THE COVERED PARTIES DO NOT ASSUME LIABILITY FOR ANY INJURY, DAMAGE, DEATH, LOSS, ACCIDENT OR DELAY DUE TO AN ACT OR OMISSION OF A RENTAL SUPPLIER, INCLUDING, WITHOUT LIMITATION, AN ACT OF NEGLIGENCE OR THE DEFAULT OF A RENTAL SUPPLIER. FURTHER AND TO THE EXTENT PERMITTED BY LAW, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY DAMAGE AND/OR DELAY DUE TO SICKNESS, PILFERAGE, LABOR DISPUTES, BANKRUPTCY, MACHINERY BREAKDOWN, QUARANTINE, GOVERNMENT RESTRAINTS, WEATHER, TERRORISM OR CAUSES BEYOND THE COVERED PARTIES’ CONTROL. NO RESPONSIBILITY IS ACCEPTED FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, FAILURE TO MAKE CONNECTIONS, RE-ROUTING OR ACTS OF ANY GOVERNMENTAL AUTHORITY. You agree to abide by the terms or conditions of purchase imposed by any Car Rental, whether that Car Rental is selected by you or by ONTRAC Rent a Car, including, but not limited to, payment of all amounts when due and compliance with the Car Rental’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such Car Rental’s conditions of purchase may result in cancellation of your reservation(s) or purchase(s), in your being denied access to any reservations and/or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase(s), and in ONTRAC Rent a Car debiting your account for any costs ONTRAC Rent a Car incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Website.

Cars Information

The Cars are confirmed by category, and not by brand, model, or engine size. By booking a Car in the Platform, you, the Renter, are booking a type of Car, not a specific car brand, year, model, or characteristics that are different from those of all the vehicles of the same type. The Car Rental guarantees the size and capacity of the Car. However, the brand and model are subject to availability and location.

Payments

Payments will be processed in USD – Due to fluctuating foreign exchange rates and other possible banking charges, ONTRAC Rent a Car cannot be held responsible for any difference in the amount paid for the reservation.

Booking Confirmation and Voucher

The ONTRAC Rent a Car voucher must be presented to the Car Rental Company when picking up your rental car. We cannot be held responsible for rentals rejected if a voucher is not presented. Please carefully read the summary of the Car Rental Transaction detailed in the voucher. If after receiving the voucher, you discover discrepancy in the Terms of the Car Rental Transaction contained in the voucher, please inform us of this as soon as possible.

Car Rental Agreement

The Car Rental Transaction is subject to the terms of the Car Rental Agreement executed between you and the Car Rental Company at the time of pick-up of the car. Please carefully read the terms of the Car Rental Agreement before signing it. In any event that, prior to signing the Car Rental Agreement, you shall find any discrepancy between the summary of terms of the Car Rental Transaction specified in the voucher and those specified in the Car Rental Agreement, you are requested to notify us of this as promptly as possible and in any event, before signing the Car Rental Agreement.

We recommend that you keep a copy of the Car Rental Agreement and any other document related to the Car Rental Transaction, including documents pertaining to the drop-off of the car, in case of a future inquiry related to the Car Rental Agreement signed by you.

Age Limits for Drivers

The policy relating to the Renter’s age and any additional drivers and the minimum driving experience they hold is determined by the Car Rental Companies at their sole discretion, and according to the legal restrictions applicable in the relevant country. It is important that you must verify in advance that your age meets the Car Rental Company’s policy with respect to the Renter’s age.

In most locations, the minimum hiring age is 21 years. Additional fees can apply with certain Car Rental Companies and in certain countries for drivers aged less than 25 years or over 65 years. Minimum age requirements on larger cars may also be higher at some locations. In addition, most Car Rental Companies also require that the Renter and any additional driver shall have a minimum driving experience of 12 months.

Additional Drivers

The only person authorized to drive the Car is the main driver unless additional drivers with their full names (as they appear on their driver’s licenses) are specified in the vehicle rental agreement. Any number of additional drivers can be added to your booking. Fees may apply for additional drivers, payable at the car rental counter (unless specified otherwise on the ONTRAC Rent a Car voucher). Please note that all additional drivers must also show a valid driver’s license at the location.

Fuel

As part of our commitment to provide competitive, honest, fair and transparent pricing, we at ONTRAC Rent a Car aim to only work with partners offering you a fair fuel policy – so you will get no unpleasant surprises with hidden extras. This option is available in most countries; however always check the fuel policy for the Car Rental Company you have chosen. A fair fuel policy means that you return the car with the same amount of fuel you picked it up with.

Full/Full Policy

You are given the car with a full tank of fuel and you are asked to bring it back with a full tank of fuel. If you do not bring it back with a full tank, then you may be charged a refueling charge plus an inflated cost for the missing fuel. Follow the simple rules and you only end up paying for the fuel you have used.

Return as Received Policy

On collection your rental car will have a certain amount of fuel, which will be marked on your Car Rental Agreement; return the car with the same amount of fuel as you collected it with. Always check that the fuel level is the same on the Car Rental Agreement before you leave the rental station.

Pre-Purchase Policy

If you choose this option you pay for the fuel at pick-up time and return the car as empty as possible. This option comes in handy if you are in a rush on your return to the rental station, as you will not have to worry about finding a gas station on the way to drop off the car.

Take note that under no circumstances is the fuel included in the rental price. In any event, we recommend that upon pick-up of the car you shall check the fuel gauge in order to ensure that the condition of the fuel tank is consistent with that specified in the Car Rental Agreement.

Insurance

When you rent a car, wherever you are in the world, you will usually need some kind of excess insurance. Please read to see what is included/excluded in the insurance package you choose. Should you decide to purchase insurance directly from the Car Rental Company we recommend that you check prior to or upon picking up the car what the exclusions to the insurance coverage included in the Car Rental Transaction are.

Furthermore, please note that Car Rental Company insurance coverage usually do not cover damages incurred to the clutch, upholstery or window panes, damages to the tires or repair of flat tires and any related expenses, towing fees or spare key costs as well as damages incurred to the content of the car or to its passengers.

Insurance and Additional Services Hired in the Destination Country

In the destination country, the Car Rental may offer you to hire additional services (such as insurance policies with higher coverage, airport fee, gas charges, additional driver charges, GPS, seats for minors, among others), which shall be hired directly by you and charged by the Car Rental without any intervention of ONTRAC Rent a Car. Hiring these additional services is a voluntary decision. ONTRAC Rent a Car does not intervene and is not liable for any resulting amounts you, the Renter, have to pay.

Additional Charges

During the rent period, some charges or debits not immediately claimed by the Car Rental, payable by you, the Renter, may generate (as a result of fines for traffic violations, car damages, or broken or missing parts). You, the Renter, shall pay such fines and additional charges when they are claimed by the Car Rentals. These additional charges depend on the policies of each Car Rental and are charged by it directly, without any intervention whatsoever of ONTRAC Rent a Car.

Taxes and Fees

In some destinations, the service purchased does not include local taxes and/or state surcharges, which are payable by you, the Renter, at the time of picking up the Car, directly to the Car Rental. This situation shall be fully informed about in the Platform.

Tolls

In some jurisdictions, you, the Renter, may hire a toll collection service directly from the Car Rental (such as the SUN PASS, in the state of Florida, in the United States), which allows you to move comfortably and avoid fines. You may freely hire this service from the Car Rental directly. It is important to highlight that ONTRAC Rent a Car is not liable for any resulting amounts.

Amendments and Changes

No charge will be made for amending your booking before the start of your rental. This excludes any cost increases caused by a material change to the booking, such as its duration or the car class – or by the Car Rental Company changing its rates following the original booking. With certain Car Rental Companies, amending the driver’s name or the pick-up location may require the cancellation and re-booking of a rental. Terms and Conditions vary per Car Rental Company and will be clearly communicated during the booking process.

Extension of a rental booking can either be made by making a new booking via ONTRAC Rent a Car (requires confirmation by a local provider, not necessarily the same) or by arranging it with the local provider. In case that the customer wishes to drop the car off earlier than booked, ONTRAC Rent a Car will not refund any amount for the unused days. It is entirely up to the Car Rental Company whether they decide to do so or not.

Cancellation

If you wish to cancel a booking, the only accepted method is through the ONTRAC Rent a Car website. Do not cancel your booking with the Car Rental Company directly as additional fees may apply. No refund will be made, if the rental is terminated early, the pick-up is delayed, if the Renter fails to appear or if a cancellation is made less than 48 hours before the starting date of the rental period. No refund is given if you do not have a valid driving license that is accepted by the rental company. In addition, no refund is given if you cannot present an accepted credit card for the security deposit. Please keep in mind that different Car Rental Companies have different requirements for accepted methods of deposit authorization and payment. The extension of the rental period and a delayed return of the vehicle will be calculated and charged in accordance with the local daily price (which can be higher) by the Car Rental Company and penalty fees may apply.

We reserve the right to cancel your booking in the event we have reasonable grounds to believe it is fraudulent. In such circumstances we may cancel your booking with no liability whatsoever. In the event your booking is cancelled, a full refund will be made of all monies previously paid to us to the person that originally paid for the booking.

No-Show

A “no-show” is when you:

  • Wish to cancel but do not tell us until your rental is due to start, or
  • Fail to pick up the car at the arranged date at time, or
  • Fail to provide the documentation that’s required to pick the car up, or
  • Fail to provide a credit card in the main driver’s name with enough funds to cover the deposit.

In all of these cases, you’ll receive no refund of the money you’ve paid.

The car hire company reserves the right to refuse the car to any customer who fails to arrive on time with all necessary documentation and a credit card with enough funds. In such a case, unless the rental has been cancelled in advance, the customer will not be entitled to a refund.

No Cancellation Fee

If you cancel anytime before your rental is due to start, the money you’ve paid will be refunded in full by ONTRAC Rent a Car. The time it will take to reimburse your rent will depend on the Cancellation Policies specified in each Car Rental.

If you fail to provide all the necessary documentation, the Car Rental may refuse you the car and no refund will be made. No refunds will be made if the rental is terminated early.

Picking up and Returning the Rental Vehicle

Please note, the Car Rental Company is not obligated to wait for your arrival, and if you fail to arrive at the Pick-Up Station at the time indicated in the voucher this may constitute a No-Show on your part.

At the end of the rental period, you have to return the vehicle to the correct location and at the agreed time without damage and in a clean condition. Please make sure you return the vehicle to the same rental company from which you picked it up.

In the event the car is dropped off unreasonably dirty, as determined solely by the Car Rental Company, the Car Rental Company may charge you for special cleaning fees.

Driving License

Every driver must have a full, valid driving license that they have held for at least 1 year (2 or more years required at certain locations). Expired or provisional licenses will not be accepted. When picking up the Car, every driver must present his or her license. Some Car Rental Companies in some rental countries may also require an International Driving Permit. All drivers must also keep their driving license with them at all times throughout the rental, for inspection by local authorities.

No refunds will be given if a Car Rental Company refuses to supply a car because of undisclosed endorsements – or because you cannot provide a driving license, its counterpart, or the required information about endorsements.

Force Majeure

ONTRAC Rent a Car is not liable for any delay in meeting its obligations due to causes outside its reasonable control including acts of God, riot, war and malicious acts of damage, fires or electricity supply failure. For a confirmed booking, in the event that the local provider is unable to perform its obligations in providing the vehicle due to insolvency, we will do our best to re-direct your booking to another Car Rental Company. In peak periods this may not be achievable. In such case where we have no alternative provider, you will be notified of this, the booking will be cancelled and the advance payment returned.

Complaints

ONTRAC Rent a Car are committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns regarding our service. If you, the Renter, are dissatisfied in any way with your rental, please report this to the Car Rental Company directly as soon as possible.

Technical Problems

In case of technical problems with the vehicle you must inform the Car Rental Company immediately. You will find the telephone number in the Car Rental Agreement. The Car Rental Company has to give its consent to repairs and replacements. If you, the Renter, are involved in an accident, the local police and the Car Rental Company must be contacted. Keep copies of all relevant documentation you are asked to complete. This may be needed if you wish to make a claim.

Breakdown/Accident

In the event of a breakdown or accident, etc. you must contact the Car Rental Company immediately for instructions and assistance. It is highly recommended to call the police even for the smallest of damages. All related documentation must be kept if an insurance claim is submitted. If you fail to act accordingly, the Car Rental Company may charge you for damages incurred to it as a result.

Please note, if an accident is caused by your negligence or in any other circumstances in which the insurance coverage of the insurer is excluded, you shall be responsible for all the damages incurred to the Car Rental Company.

Different Jurisdiction

If you, the Renter, are planning to drive to a different state, before filling in the Purchase Order please make sure that the Car is authorized to travel in that destination. Some Car Rentals may forbid or impose an additional charge for traveling in a different jurisdiction. Please review the related conditions set forth by the Car Rental.

Pricing Errors

We endeavor to publish and maintain accurate prices and information for the services we offer. Our Providers provide us with the price and other information related to these services. In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from our Providers, we retain the right to refuse or cancel any Orders placed for such service. We shall have the right to refuse or cancel any such Orders whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your Order is canceled because of incorrect Provider information, we will promptly issue a credit to your credit card account in the amount of the charge.

Termination of Usage

User access to all or part of this website may be terminated or suspended at any time, without notice and for any reason.
